Understanding the new announcement about Safety Data Sheets (GBF) by MoEUCC

Announcement on Safety Data Sheets

As per the article 64 of the Regulation on Registration, Evaluation, Authorization, and Restriction of Chemicals (REACH) published in the Official Gazette No. 30105 (repeated) dated 23.06.2017, the Regulation on Safety Data Sheets Related to Hazardous Substances and Mixtures published in the Official Gazette No. 29204 dated 13.12.2014 (SDS Regulation) has been repealed.

Therefore, the validity of the existing SDSs prepared under the SDS Regulation, which did not require updating as per paragraph three of article 28 of the REACH Regulation, will continue.

However, after the expiration of the document period, SDSs prepared in accordance with the SDS Regulation must be prepared in accordance with the provisions of Part 4 of the REACH Regulation by Chemical Assessment Experts who have been certified under REACH.

In the event of any change in the composition of a chemical substance and/or in accordance with paragraph three of article 28 of the REACH Regulation, an updated version must be obtained.

After 31.12.2023, SDSs will be prepared by Chemical Assessment Experts certified according to Annex 18 and in accordance with Annex 2 of Article 27 of the REACH Regulation.

Moreover, it is required that SDSs be uploaded to the Safety Data Sheet Notification System application in the Integrated Environmental Information System (IEIS).”

Regulatory Evolution

The regulatory landscape for chemical management in Turkey has undergone a notable transformation with the revocation of the GBF regulations and the introduction of the KKDİK framework. This pivotal shift places new demands on businesses to adapt their safety data sheets to comply with contemporary standards. The subsequent discourse provides an analytical perspective on the transition’s implications, delineates the responsibilities it entails, and outlines the imperative timelines for compliance, serving as an indispensable reference for industry professionals.

The Role of Certified Experts

The transition phase holds strategic importance. Subsequent to the lapse of a GBF document, the reconstitution of safety data sheets must be executed by Chemical Assessment Experts, duly certified under the KKDİK legislation. These professionals ensure the revised documentation is in strict adherence to Part 4 of the KKDİK regulation, capturing any substantive changes in chemical properties or adjustments in regulatory mandates.

Obligatory Revisions

Alterations in chemical structures or regulatory updates under Article 28, Paragraph 3 of the KKDİK mandate the acquisition of updated safety data sheets. This requirement ensures that all parties, from manufacturers to emergency personnel, have access to the most recent and pertinent chemical hazard data.

Compliance Deadline

The date of December 31, 2023, stands as a critical juncture for compliance. Beyond this date, all safety data sheets must be in alignment with Article 27 of the KKDİK regulation, crafted in concordance with Annex 2, and ratified according to Annex 18 by sanctioned Chemical Assessment Experts. This deadline underscores the pressing need for organizations to bring their safety documentation into conformity with KKDİK stipulations.

Integration with IEIS

A distinctive element of the KKDİK regulation is the compulsory incorporation of safety data sheets into the Integrated Environmental Information System (IEIS). This integration mandates a centralized database for safety data, enhancing the efficacy of compliance tracking and accessibility.

Conclusion: Forward-Looking Compliance

The institution of the KKDİK regulatory framework underscores Turkey’s commitment to advancing chemical safety and compliance standards. By transitioning to KKDİK-sanctioned practices, companies not only fulfill statutory obligations but also champion a safer industrial milieu. As the December 31, 2023, deadline draws near, the imperative for engaging qualified Chemical Assessment Experts intensifies. Concurrently, the synergy with the IEIS epitomizes a paradigm shift towards a more lucid and systematic modality of safety data administration.
